Maryland Rule 2-121: Service of Process Requirements
All civil process service in Maryland is governed by Maryland Rule 2-121, which sets out how, when, and by whom legal documents must be delivered. Under Rule 2-121(a), service on an individual may be made by delivering a copy of the summons and complaint personally, by leaving copies at the individual’s dwelling house or usual place of abode with a person of suitable age and discretion residing there, or by mailing to the individual’s last known address by certified mail requesting “Restricted Delivery — show to whom, date, address of delivery.”
Rule 2-121(b) addresses service by posting where personal service cannot be accomplished after diligent effort. Rule 2-121(c) establishes that service may also be made outside the State in the same manner as service within the State.
Failure to comply with these requirements can result in a motion to quash service, delaying your case. Capitol Process Services has served documents under Rule 2-121 across Maryland for over 40 years — we know exactly what courts require and ensure every attempt is documented thoroughly for your affidavit of service.

Frequently Asked Questions: Maryland Process Server
What is a process server and why do I need one in Maryland?
A process server is a licensed professional who delivers legal documents — such as summonses, subpoenas, complaints, and orders — to the named parties in a lawsuit. Maryland courts require proper service before a case can proceed. Using a professional process server ensures documents are served in compliance with Maryland Rule 2-121 and that a valid affidavit of service is prepared for filing.
Does Maryland require a licensed process server?
Maryland does not require process servers to hold a statewide license, but they must comply with Maryland Rule 2-121 and related court rules. Many attorneys choose a professional process serving firm to ensure service is properly documented, legally defensible, and handled by someone familiar with local courthouse requirements.
What does Maryland Rule 2-121 require for valid service?
Maryland Rule 2-121 permits personal service (hand-delivery to the individual), substituted service (leaving documents at the person’s residence with a suitable person), or certified mail with restricted delivery. For business entities, Rule 2-103 applies. If diligent attempts fail, Rule 2-121(b) allows service by posting. Capitol Process documents every attempt to ensure your affidavit of service is complete.
How long does process service take in Maryland?
Standard service is typically completed within 3–7 business days for most Maryland addresses. Rush service is available for time-sensitive matters. Remote or rural addresses — such as parts of Garrett, Somerset, or Worcester counties — may take slightly longer. Contact us at (202) 667-0050 to discuss your timeline.
How much does a Maryland process server cost?
Fees vary based on the number of attempts required, the urgency of service, and the location within Maryland. To get a quote for your specific matter, call us at (202) 667-0050 or Request Service online and a team member will follow up promptly.
Can you serve someone who is avoiding service in Maryland?
Yes. Capitol Process Services specializes in difficult serves, including evasive individuals, gated communities, and secure buildings. If personal service cannot be completed after diligent attempts, we can also pursue substituted service under Maryland Rule 2-121 or advise on service by posting. Provide us with as much information as possible and we will handle the rest.
Do you serve legal documents statewide, including rural Maryland counties?
Yes. We serve all 24 Maryland counties, including the Eastern Shore, Western Maryland, and Southern Maryland counties that many local process servers cannot reach. Our statewide network ensures documents can be delivered wherever your subject is located.
What documents can Capitol Process serve in Maryland?
We serve all civil process documents, including summonses and complaints, subpoenas (trial and deposition), restraining orders and protective orders, divorce and family law papers, eviction notices, and demand letters. We also offer skip tracing to locate hard-to-find individuals, document filing at Maryland courthouses, and court document retrieval services.
